Data Protection
Data protection features of the Website
At Marles Group companies, we recognise the importance of data protection and have implemented a number of measures to improve the protection of personal data or sensitive information that these companies receive or transmit over the internet. First of all, a secure connection is established using "Secure Socket Layer (SSL)" technology. This happens whenever you transmit or access personal data or sensitive information in one of our secure online areas. SSL technology establishes a private communication that can only be understood by the communication system on your computer and the communication system of Abanka and its affiliates. SSL technology encrypts the data sent over the internet between the system on your computer and the system of Abanka and its affiliates, thereby ensuring that the transmitted data remains encrypted. The use of SSL requires two components: a browser with an SSL option, and a web server that performs the exchange of keys and thus establishes a secure connection to the Marles web server systems.
Technological requirements for the use of SSL technology
1. Suitable browser
You need a browser with the SSL option. Examples of such browsers are Firefox and Microsoft Internet Explorer from version 2.0. Please note that some older browser versions do not support SSL connections. If you do not have a browser with SSL, you can download an SSL browser from the internet. In order to securely access your personal data or sensitive information online, we recommend that you use the latest browser versions available.
2. A suitable internet service provider
Almost all internet service providers (ISPs) automatically provide the secure SSL connection described above. If you are using your company's internal connection to access the internet and find that you cannot open the secure pages of Abanka and its affiliates using the SSL browser described above, this may be because your company is blocking access using a firewall. Please discuss any additional details regarding your internet access with your company's internet access system administrator.
Username and password
Certain areas of the Website require the use of a username (your email address) and password as a security measure to help protect sensitive information. In this way, Marles and its affiliates verify your identity to enable you to access your data and (password-) protected areas of the Website and to prevent unauthorised access. Please bear in mind that browser software often caches a page when you view it, which means that some pages are stored in your computer's temporary memory. Therefore, when you click on the "Back" button, it may show you a saved version of the page you were previously viewing. Caching in no way affects the security of your confidential username or password. If you use a computer in a public place to access your data and (password-) protected parts of the Website, you should close the browser before you leave to reduce the chance of someone else having access to your confidential data and (password-) protected parts of the Website.
Linking to other websites
You should bear in mind that other websites to which you connect via the Website or email of Abanka and its affiliates (Linked Sites) may contain data privacy provisions that differ from the provisions of this Online Data Privacy Statement. To protect your privacy, we recommend that you review the privacy statements of other websites that you visit.
Principles regarding the privacy of user information
We only collect the user data that we need and we explain to Users how we use it. When we collect user data, we limit it to the data that we need to customise the Website, to provide services to (registered) Users, to offer new services, and to comply with legal requirements and regulations. We also explain to Users the general use of the data that we collect about them and offer additional explanations upon request.
Users can choose how their data will be used
This Website offers registered Users the possibility to decline when deciding whether their data should be used to make sales offers. These marketing choices include offers from Marles Group companies for services and offers from our business partners. Of course, Users can still receive the universal offers and notifications to which they have subscribed.
Data quality assurance
We use advanced technology, documented procedures and internal monitoring practices to ensure that user data is processed quickly, accurately and completely.
We use sensible data security protections
We only allow access to systems containing data on registered Users to those who specifically need it to carry out their work and fulfil their duties in the area of servicing registered Users. We use safeguards designed to protect the confidentiality and security of the data of registered Users.
We restrict the disclosure of information about registered Users
We only disclose personal (and other) data about registered Users with the permission of the User to whom the data relates or if so required by law.
These data privacy principles also apply to our business relationships
We encourage our business partners to take appropriate care of their clients' data by adopting ongoing and effective data privacy policies and practices, including the clients' choice to decline sales offers. In addition, we actively participate in business associations where we advocate for the development of comprehensive data privacy policies and implementation strategies.
Personal Data Protection
Marles Group companies may process personal data of persons with whom they have a contractual relationship if the personal data is necessary for the performance of a contractual obligation or the exercise of rights under a contractual relationship or if they have the written consent of the data subject for the processing of their personal data.
Security of the premises
The premises where the media, hardware and software containing personal data are located are safeguarded by organisational and/or technical measures to prevent unauthorised persons from gaining access to personal data.
Communication networks
Personal data may be communicated by information, communication and other means only if procedures and measures are in place to prevent unauthorised persons from seizing or destroying the data and from gaining unauthorised access to its contents.
External users of the data
Marles Group companies may only disclose personal data collections to external users if they have been authorised to use them by law or on the basis of a written request or consent from the data subject. External users may only use the data obtained for the purposes set out in the Personal Data Protection Act and may not pass it on to other users.
Marles Group companies may only disclose personal data to a person who is not a data user under the Personal Data Protection Act if that person intends to use the personal data for statistical or scientific research purposes, in a form that does not permit the identification of individuals.
Deletion of personal data from the database
Personal data may be stored and used only for as long as necessary to achieve the purpose for which it was processed.
After the purpose referred to in the preceding paragraph has been fulfilled, the personal data is deleted from the database or blocked, unless otherwise provided by law for specific types of personal data.
When deleting personal data from computer media, a method of data erasure is applied which makes it impossible to recover all or part of the deleted data.
Rights of the data subject
Marles Group companies must, at the request of a registered user of the Website:
- provide access to the data catalogue, access to and copying of the personal data contained in the database relating to the User;
- provide an extract of the personal data contained in the database relating to the User;
- provide a list of persons to whom personal data contained in the database and relating to the User has been communicated during a specified period;
- provide access to the sources on which the records contained in the database relating to the data subject are based and to the method of processing.
The request referred to in the preceding paragraph must be made in writing to the Marles Group company as the controller of the personal data file.
